Terms of Use

These Terms of Use (hereinafter — 'Terms') govern the rules of using physical and digital services, the in-cafe Wi-Fi network, and official internet resources (or official domain names that will replace them in the future) provided by L'Oben (hereinafter — 'Cafe'). By using our services and internet resources, you are deemed to have fully and unconditionally accepted these terms.

1. General Rules and Wi-Fi Use

  • It is forbidden to exhibit behavior that violates the rights of other customers/users, is unlawful, offensive, or unethical within the Cafe or on our digital platforms.
  • The free Wi-Fi network provided by the Cafe for customers is protected by a general password. During the use of the Wi-Fi service, no personal data, registration number, or device information is collected or processed from the users.
  • It is strictly forbidden to use the Wi-Fi network for unlawful activities (copyright infringement, cyber attacks, distribution of malware, downloading legally prohibited content, etc.). All legal and criminal liability for any law violation committed within the network falls directly on the respective user.

2. Nature of the Website and Absence of Online Sales

  • Our official website and digital platforms are solely for information, promotion, brand visuals, and menu display purposes.
  • No online sales, product delivery, order acceptance, or digital payments are conducted through the website or any of our online platforms.
  • All product orders, service purchases, and payments are carried out only inside the Cafe using physically accepted payment methods.

3. Prices and Taxes

Prices shown on the website, digital platforms, or physical menus include all taxes in force (including VAT) in accordance with the legislation of the Republic of Azerbaijan (unless a special note regarding a different service fee is specified in the menu).

4. Intellectual Property Rights

  • The Cafe's name (L'Oben), logo, branding elements, interior and exterior design concepts, menu structure, official website text, graphics, photographs, and software belong to the Cafe (or are used under license) and are protected by international intellectual property laws.
  • Copying, reproducing, distributing, modifying, or using these materials for commercial purposes without prior official and written permission of the Cafe is strictly prohibited.

5. Limitation of Liability

  • The Cafe is not liable for temporary interruptions in digital services or the website's operation due to technical faults, internet provider disruptions, server errors, or force majeure events (natural disasters, accidents, global communication issues, etc.).
  • The Cafe is not liable for any digital data or financial loss arising from the user's failure to ensure the security of their personal device (e.g., leaking personal information or passwords to third parties while using the Wi-Fi network).

6. Governing Law and Dispute Resolution

  • The interpretation, application, and relations arising between the parties under these Terms are entirely based on the legislation of the Republic of Azerbaijan.
  • All disputes arising from these Terms or the use of services shall initially be resolved through mutual negotiations and understanding between the parties, and if no agreement is reached, by the competent courts of the Republic of Azerbaijan.

7. Amendments to the Terms

The Cafe reserves the right to change, update, or cancel some clauses of these Terms of Use at any time, unilaterally. Updated terms become effective upon publication on the official platform. Your continued use of the services and the website implies acceptance of the updated terms.
